1. Purpose and definition of the online contract
An “online” contract means a distance contract for the purchase of goods and/or services concluded between Alessandra Borriello S.r.l., with registered office in Torre del Greco (NA), Viale della Gioventù 10/B, postcode 80059, VAT no. 06964761214, registered with the Companies Register of Naples under no. REA NA-1378273 (the “Supplier”), and the customer, within a distance-selling system that uses the Internet.
Contracts are concluded through www.alexandracameos.com.
Consumer means a natural person acting for purposes outside any trade, business, craft or profession (Article 3(a) of Legislative Decree 206/2005 — Italian Consumer Code).
Customer or buyer means anyone who purchases on the Website, whether a consumer or a professional.
2. Acceptance of the terms
2.1. The contract is concluded when the Supplier accepts the order, by order-confirmation email (and, where applicable, shipping confirmation). Receipt of the order alone is not acceptance.
By placing an order, the customer accepts these Terms and the payment conditions.
2.2. It is forbidden to enter false data or third-party data, or to create multiple registrations for the same person. The Supplier reserves the right to take action to protect itself and other customers.
2.3. After purchase, the consumer may print or save the order confirmation and these Terms (Articles 49 et seq. of the Consumer Code).
2.4. Subject to the consumer’s mandatory rights, the Supplier is not required to pay damages arising from non-acceptance of an order, even in part. In that case it will refund any sums already paid.
3. Prices and purchase
3.1. Prices on the Website are an offer to the public (Article 1336 of the Italian Civil Code), in euros and inclusive of VAT unless otherwise stated. They may change at any time; after the contract is concluded the accepted price will not change, including in the event of fluctuations in precious-metal prices.
National and international shipping costs are borne by the customer and are shown before confirmation.
For shipments outside the EU, duties, import VAT and customs charges are borne by the customer, unless otherwise stated at checkout.
3.2. Only products in the catalogue at the time of the order may be purchased. Images are illustrative: reflections, shades and natural veining may differ in non-material ways from the actual piece.
4. Payment
4.1. Accepted methods are those shown at checkout (cards via the chosen intermediary, PayPal, Shopify Payments and any other methods enabled).
Card data are transmitted in encrypted form to the intermediary; the Supplier does not store the full card number.
4.2. If the order is cancelled within the limits of the law or is not accepted, the transaction will be reversed. Refund timing depends on the bank or payment scheme.
4.3. The Supplier may request identity documents for fraud prevention. If they are not provided, the Supplier may refuse the order and refund any amount paid.
4.4. The Supplier is not liable for fraudulent use of payment instruments by third parties, except in cases of its own wilful misconduct or gross negligence.
5. Shipping and delivery
5.1. Goods are shipped to the order address by courier, as a rule with tracking. Above certain value thresholds the Supplier may use insured shipping; any extra cost is shown before purchase.
Indicative times: within 30 days of conclusion of the contract, unless a different period is agreed, including for pieces in production (Article 61 of the Consumer Code).
5.2. Consumer: risk of loss or damage passes only when the consumer, or a third party indicated by the consumer and other than the carrier, takes physical possession of the goods. If the consumer chooses a carrier other than the one offered by the Supplier, risk passes upon delivery to that carrier (Article 63).
Professional customer: unless otherwise agreed, risk may pass upon delivery to the courier.
5.3. On delivery, check the number of parcels and the integrity of the packaging. Visible damage must be noted immediately on the courier’s document, with photos where possible.
Signing without reservation does not affect the consumer’s rights for hidden defects or lack of conformity. If the parcel appears tampered with, refuse delivery or accept with reservation and write immediately to info@alexandracameos.com.
5.4. Delays caused by force majeure, customs or repeated absence of the addressee do not in themselves constitute a breach, without prejudice to the consumer’s rights if delivery does not occur within the time limit.
5.5. If the addressee is absent, the parcel is held in storage under the carrier’s rules. After that period it may be returned to the Supplier. Storage and return costs caused by the customer are borne by the customer. The contract is not automatically terminated; the Supplier will contact the customer to arrange a new shipment or a refund, deducting documented costs where permitted.
5.6. Shipping costs are shown before the order is placed.
5.7. Tax documents are issued on the data entered by the customer. For consumers, an invoice is issued if requested or required by law.
5.8. Any discrepancy between the goods ordered and those delivered must be reported promptly to info@alexandracameos.com, without prejudice to guarantee time limits.
6. Availability, unique pieces and made-to-order
6.1. Purchases are limited to indicated availability. Many cameos and jewels are unique pieces or limited editions.
6.2. If a product is unavailable, the Supplier will inform the customer, who may wait for restocking or obtain termination of the contract and a refund.
Atelier production times are stated on the product page or in the order confirmation.
6.3. Personalisation. Engravings, specific sizing (e.g. rings), commissioned cameos and adaptations made from a sketch or the customer’s instructions are goods made to measure or clearly personalised. The right of withdrawal does not apply to these goods (Article 59(c) of the Consumer Code), without prejudice to the legal guarantee.
7. Materials, natural features and care
7.1. Cameos, shell, cornelian, stones, metals and engraved surfaces show natural variations in colour, veining, thickness and lustre. Such variations are not a lack of conformity if they are consistent with the type of goods and the product information.
7.2. Where relevant, the Supplier states the metal and fineness. Any certificate, card or pouch supplied forms part of the product and must be kept and, in the event of withdrawal, returned.
7.3. Jewellery must be worn and stored in accordance with the care instructions (avoid knocks, aggressive perfumes, chlorine, abrasives and unauthorised work). Failure to do so may exclude or reduce guarantee remedies for damage caused by use.
8. Liability and force majeure
8.1. The Supplier is not liable for non-performance due to force majeure or unforeseeable circumstances (fire, strikes, natural events, network outages, acts of authority, etc.).
8.2. The consumer’s mandatory rights remain, including a refund for goods not delivered. Any clause that shifts liability for non-delivery solely onto the courier is invalid vis-à-vis the consumer.
9. Right of withdrawal
9.1. The consumer may withdraw without giving reasons within 14 calendar days of physical possession of the goods by the consumer or by a third party indicated by the consumer and other than the carrier (Articles 52 et seq. of the Consumer Code).
Send an unequivocal statement before the deadline to info@alexandracameos.com, or use the form on the Website if available. The Supplier will acknowledge receipt.
9.2. Conditions:
- withdrawal applies to the goods as a whole;
- return them intact, in the condition received, preferably with original packaging, labels, seals, certificate and accessories;
- no withdrawal for made-to-measure or clearly personalised goods (Article 59(c)).
Trying the jewel as one would in a shop does not cancel the right of withdrawal. The Supplier may deduct any diminished value resulting from handling beyond what is needed to establish nature, characteristics and functioning (e.g. prolonged wear, used earrings, signs of wear, missing seal or certificate).
9.3. Direct return costs are borne by the consumer, unless the Supplier failed to provide the required information or agreed to bear them.
Until return, the consumer is liable for diminished value caused by handling beyond mere inspection.
Tracked — and for high-value items, insured — return shipping is recommended. The Supplier is not responsible for loss of an untracked return.
9.4. The Supplier reimburses all payments received, including standard delivery costs (not extra costs for a more expensive delivery method chosen by the customer), within 14 days of being informed of the withdrawal. The Supplier may withhold reimbursement until it receives the goods or proof of shipment.
Same means of payment, unless otherwise agreed.
The business operates from the EU: refunds in a currency other than the euro follow the exchange rate on the day of the refund.
9.5. Damage beyond ordinary inspection: the refund may be reduced by the corresponding diminished value.
10. Legal guarantee of conformity
10.1. For consumers: Articles 128 et seq. of the Consumer Code. Liability for lack of conformity that becomes apparent within two years of delivery. The consumer must report the defect within two months of discovery (Article 132). Keep proof of purchase.
10.2. Remedies: free repair or replacement or, under the statutory conditions, price reduction or termination.
The guarantee does not cover:
- improper, abusive or unintended use, or use contrary to instructions;
- normal wear and ageing of metal, engraving and organic materials;
- lack of care;
- accidents or negligence;
- alterations by the customer or third parties;
- unauthorised work on our products.
11. Governing law and jurisdiction
11.1. Italian law. For a consumer resident in another EU Member State, the mandatory rules of the country of residence remain applicable.
11.2. Consumer resident in Italy: court of the consumer’s place of residence or domicile.
